Sexual violence and the University

As a society, it is an understatement to say that we are not doing well in dealing with issues of sexual violence. Incidents of domestic abuse in Calgary are at an all-time high. The military, the RCMP and our local police force seem to be failing to protect their members from sexual harassment. A member of Alberta’s legislature requires special protection after being subject to vile misogynistic comments and a spectrum of threats, and sexual harassment of women elected to local, provincial, and federal levels of government is not uncommon. The judicial system appears to be failing complainants. The recent high profile trial of a Canadian media personality might be taken to demonstrate that a complainant in a sexual assault trial is on trial just as much as the accused. I will leave it to the legal experts to judge whether or not this represents a flaw in our judicial system. Regardless, continued widespread myths and stereotypes, particularly about women’s dress, behavior, and sexuality continue to contribute to a systemic blaming of the victims of sexual violence. Universities across Canada and the United States are also in the public eye related to incidents of sexual violence and harassment.

It is within this concerning and controversial context that University’s Administration is proceeding with a policy to address sexual violence.  We agree all members of the University community deserve a safe learning, living and working environment, and that victims of sexual violence need to feel comfortable and safe in reporting such violence. Measures to debunk stereotypes and myths, and to raise awareness and understanding of consent regarding sexual relations are essential in addressing sexual violence. Support must be given to those whose lives have been traumatized by sexual violence. However, as concerning and unacceptable sexual violence is, it is also critical to ensure that procedures put in place to address the problem fairly protect the rights of all members of the university community and should not create the presumption of guilt until proven innocent. However well intended, procedures to address sexual violence need to recognize their potential impact and irreparable damage to the lives of all involved.

The Faculty Association has always played an important role both in supporting victims of sexual violence on campus and ensuring a fair process. It is from this experience that the Faculty Association should and must speak out to raise important concerns about the proposed Sexual Violence Policy. I will mention only a few of the issues that need to be carefully addressed.

The Administration’s current draft of a new Sexual Violence Policy defines sexual violence and outlines reporting procedures and how such reports are to be dealt with. Careful consideration is needed to ensure that the Collective Agreement is not violated, and that fundamental and procedural fairness are adhered to.

The Policy deals with complex issues fraught with emotion and an understandable sense of urgency. However, it is questionable whether this policy can or should be able to reach into the private lives of a married or cohabiting couple, as some sections of the draft seem to suggest. Further, the policy does not adequately address how privacy will be ensured, including the creation of files, their content, where they will be kept, who will have access to them, and how long and in what cases such files will be maintained.

In summary, very careful framing of the Policy is needed to ensure that complainants and respondents are treated fairly, that no collective agreement is violated, and that fundamental and procedural fairness are adhered to. If we get this policy wrong, we risk doing great harm in spite of the best of intentions. Therefore, let’s take the time and care to get it right.

Sessional Travel Grant application deadline approaching

In recognition of the contributions of sessionals to the academic environment the Association is awarding Sessional Travel Grants. Three grants of up to $2,000 each are available. The deadline for application is December 14, 2016.

These grants serve to support the academic goals of sessional members of the Faculty Association by providing funding for a portion of travel costs related to making scholarly presentations, attending conferences, or other scholarly activity in their field. The purpose of this grant is to provide these members an opportunity to profile their research, remain current in their fields, and thereby benefit the University with their enhanced expertise and profile.

Sessional applicants must have completed at least three (3) half-course equivalents at the University of Calgary between September 1, 2015 and December 31, 2016. Applicants must also be contracted at the University of Calgary for the Fall 2016 and/or Winter 2017 semesters. Travel must be completed by December 31, 2017.

Grant recipients will be selected by the Faculty Association based on the quality of their application and the relevance of the conference/scholarly activity to the research/field of study. Sessionals making scholarly presentations or undertaking a similar scholarly endeavor appropriate for their field of work will normally be given priority consideration.

Salary anomalies process for 2016-17

The Compensation Disclosure Regulation (commonly known as the Sunshine List) has triggered a number of academic staff to come forward with concerns about anomalous salaries. In discussing this with the Provost, the Parties have agreed to open up the salary anomalies process to allow for academic staff to bring forward concerns this upcoming year, regardless of the date of hire. Normally academic staff are only eligible to apply within ten years of hiring. Salary anomaly decisions will still be based on one’s starting salary. We suggest those academic staff who believe they have an anomalous salary speak with their Department Head or equivalent. Also, the Faculty Association would be happy to answer any questions academic staff may have. Deadlines associated with this process will be provided in the new year. The Salary Anomalies Advisory Committee normally meets in the spring to discuss all cases and provide advice to the Chair of the Committee (Provost and Vice-President (Academic) or her designate).

Holiday closure

Academic staff are not required to work on December 23, 2016.

As per the Collective Agreement, Schedule A, Article 2.15, academic staff are entitled to paid holidays including Christmas Day, Boxing Day, New Year’s Day and three (3) designated work days between Christmas Day and New Year’s Day. Because statutory holidays fall on the weekend this year, there is also a requirement to have a corresponding weekday off in lieu of these days.

Academic staff may have noticed that the original schedule put forward by the administration did not include enough days off to accommodate the various paid holidays outlined above. The Faculty Association initiated a grievance on the matter as an informal solution was not possible. The Faculty Association believes (and precedent would indicate) that academic staff are entitled to all of the paid holidays as per the Collective Agreement.

The grievance was resolved and academic staff do not have to work December 23, 2016. There may be some instances where an academic staff member may have to work this day as required by their Department Head or equivalent, however they are entitled to a mutually agreed day in lieu on a different date.

Faculty Association supports local food banks

In lieu of holiday gifts, the Faculty Association has a tradition of donating to local food banks. This year, the Campus Food Bank and the Calgary Food Bank received a donation of $2,500 each in recognition of the valuable support they provide during the holiday season.


University of Manitoba strike support

During the recent academic staff strike at the University of Manitoba, representatives of faculty associations from across western Canada happened to find themselves in Winnipeg for a Western Regional conference. The conference is held annually to discuss issues concerning post-secondary education and research related to the work of academic staff.

As part of the conference, attendees were eager to show their support for the academics on the picket line. Sandra Hoenle, Faculty Association President, and Jennifer Krygier, Faculty Association Professional Officer attended a lunchtime rally with many, many other supporters of the University of Manitoba Faculty Association (UMFA) on November 4, 2016. In line with Faculty Association policy, $5,000 was also donated to UMFA to support their strike efforts.

After 20 days on strike, UMFA and the University of Manitoba reached a tentative deal which was ratified by the members on November 21. More information can be found on the UMFA website here.

Department Representatives 2016-17

Each department (and in the case of non-departmentalized Faculties, each Faculty) has the opportunity to appoint an individual to be a Faculty Association Department Representative. The role of the Department Representative is as liaison between the Faculty Association Board of Directors and the department or Faculty.

In order to maintain effective communication, both from and to members, the Association has established regular Department Representative meetings. Through these meetings, discussion can take place on the current issues facing the Association, its members, and the University community.

The Association encourages Department Representatives to be diligent in gathering and relaying information in both directions. Department Representatives communicate their academic colleagues’ views to the Association, and reciprocally inform academic staff in their area of the Board of Directors’ priorities, positions and activities. The Department Representatives are encouraged to attend the scheduled meetings whenever possible.

After each meeting, Department Representatives are urged to provide a summary to their colleagues by email. To facilitate this, the Association produces a Bulletin which includes the main points discussed at the meeting. The Bulletins are also posted on the Faculty Association’s website (available here). Department Representatives can of course provide and solicit feedback in whatever form best fits their area.

Academic staff are encouraged to send their comments or feedback to their Department Representative or to forward it directly to the Faculty Association office.  Department Representatives are asked throughout the year to gather input from their colleagues and provide it to the Association.

Department Representatives are often approached by members of their departments or units with questions or problems in relation to academic staff matters and asked for advice. Since answers to many such questions and problems have complexities, ramifications, and implications legal and otherwise of which the Department Representative may not be aware, the Department Representative is asked to always refer such questions, problems and requests for advice to the Faculty Association office.

For similar reasons, if a Department Representative is approached by a colleague for advice and assistance on FTPC matters, they should refer the colleague to the Faculty Association office.

Board of Directors nominations

The Faculty Association is seeking nominees to the Board of Directors.

The term of the President and Chair of the Board of Directors, Sandra Hoenle, is expiring on June 30, 2017. Hoenle is eligible to stand for a one-year extension of her term, and nominations of other candidates are invited. As per the Association by-laws, any member nominated for President and Chair of the Board shall have been a member who has served on the Board of Directors for at least one year during the previous five years.

There are five (5) three-year terms, and one (1) two-year term open for election on the Board of Directors. The designated sessional seat, a one-year term, is also open for election. Nominees must be current members of the Association, or have held a sessional position at some point since May 1, 2016.

The deadline for nominations is Wednesday, February 8, 2017 at 4:30 p.m. Nominations must be received at the Faculty Association office by that time.

Nominations must be received in writing. Also required on the nomination form are the signatures of at least three members of the Association, as well as the written consent of the nominee. Nominations should be accompanied by a statement from the nominee of a maximum 100 words, which will be circulated along with the ballots. No member may nominate more than two candidates.

Potential candidates should be aware that the Board of Directors meetings are regularly scheduled on Tuesday afternoons, approximately once per month from September to June. Additional meetings are scheduled as required. Directors are also regularly appointed to a variety of other Association, University, and external committees as representatives of the Association.

CAUT nominations open

Nominations are being sought for election to the Canadian Association of University Teachers (CAUT) Executive Committee, namely:  President, Vice-President, Chair of the Academic Freedom and Tenure Committee, Chair of the Contract Academic Staff Committee, Co-Chair of the Equity Committee (1), Representative-at-large (Quebec), Representative-at-large (Aboriginal), Representative-at-large (Francophone), and Two Representatives-at-large (General). The deadline for nominations is March 1, 2017.

Nominations are also being sought for election to positions on four CAUT Standing Committees: Academic Freedom and Tenure Committee (three vacancies); Collective Bargaining and Economic Benefits Committee (three vacancies); Equity Committee (ten vacancies); and Librarians’ and Archivists’ Committee (four vacancies). The deadline for these nominations is February 1, 2017.

Faculty Association office holiday closure

The Faculty Association office will be closed Friday, December 23 for the holiday season and will reopen on Tuesday, January 3. The Association’s voicemail will be checked regularly on days the University is open. Have a safe and happy holiday!
